Longboarding on Highways - Police involved?

K Pres posted,

I heard from someone recently that longboarders are getting pulled over and ticketed by police on the Sunshine Coast Highway (101) near Sechelt, BC, Canada.

They are apparently a nuisance to traffic.

Can anyone confirm this? I can't seem to find news on the internet about it.

sfu security cant stop you from skating gaglardi or hastings its not part of the campus, and the cops dont care as long as your being respectful to traffic and wearing safetey equipment. securty called the cops on me once for skating gaglardi, but the cops ended up bitching at security for wasting their time

next time ask the cop which statute or act he is trying to apply the force of law to (as Canadians we have no laws....just statutes and acts they try to put the force of law to....everything they do to us is by our own consent....DO NOT CONSENT TO ANYTHING ), and politley ask him to be specific about it. As well, ask him if he is a peace officer(all RCMP are peace officers)when he or she says yes they are a peace officer, ask if they have a signed statement from an injured 3rd party specifically stating the breach of the peace they witnessed or whether they have observed you breach the peace....skateboarding is not breaching the peace, we still have the common law right to travel on the roadways in CAnada, and if they state otherwise, politley ask to show you which statute or act specifically revokes this right....also remember that a skateboard is not defined under the Transportation act....it is not a motor vehicle and you are not a pedestrian while riding your board...do not let them tell you otherwise....we have definitions of a motor vehicle and pedestrian....we are neither while riding the board....remember the skateboard is NOT defined as something that is illegal to ride on highways...you are exercising your common law right to travel on Canadian highways....politley let the officer know you DO NOT consent to any conversation with a peace officer who does not have either a signed 3rd party statement or has themselves witnessed you breach the peace....BE POLITE...no one like a mouth piece....but be firm in what you say and are standing for...they have NO authority over us until we consent to it....everything in law is by contract...no contract= no consent=skating like the freemen we are!.......witnesses help too...keeps the popo in check...hope this helps

And actually told me about running red lights at which ppoint i listen and left...

Hahahaha try searching skateboarding
http://www.qp.alberta.ca/570.cfm

There's alot of stuff you have to look into on this site Bean, cuz I dont see them get close to mentioning a skateboard anywhere!!!

but this one there close to us, but its not descriptive enough (ww) “vehicle”, other than in Part 6(offroad vehicle), means a device in, on or by which a person or thing may be transported or drawn on a highway and includes a combination of vehicles but does not include a mobility aid.

Part 6
Off‑highway Vehicles

Definitions

117 In this Part, (ix) any other means of transportation that is propelled by any power other than muscular power or wind.
So a skateboard is not a vehicle or a "cycle" (means a bicycle, power bicycle, motor cycle or moped)
We are not a motor vechile because we propel ourselves "(x) “motor vehicle a vehicle propelled by any power other than muscular power, or (ii) a moped,
but does not include a bicycle, a power bicycle, an aircraft, an implement of husbandry or a motor vehicle that runs only on rails;

It's good to know my rights! I'm going to do some more research this week. I didn't have time on the weekend.

It looks like I need to look in the Criminal Code (particularly Section 31 and 32). I need to find out where Mischief is covered, as well as any local bylaws. I need to find BC's Traffic Act. Bill of Exchange Act, too. Is there anything else?

Bean, your best bet is too say you didn't cause any alarm in the peace, prove you can control your speed by giving a demonstration. It's not a stunt anyway its a sport!!! In Can more there is people using roller skies down a lot of the hills, and what about a bike? Couldn't they startle drivers as well. Say your pursuing your passion in downhill skateboarding as a sport this is practice for your sport!!! Tell them about the races you've been to look professional B)

I have taken the liberty of reading this entire thread due to my current state of injury. I must say, all I have read so far is gold and shall be instigated in my next popo confrontation. There is still one thing that plagues my mind regarding this topic in which a cop has tried to use on me and that is Disrupting traffic patterns. Is this viable breach of Law?

Sv replied,

All these suggestions sound great, but there are also cops out there who don't want to be called to a scene where some driver smeared you all over the road... I am sure you will want a lawfull identity when your face resembles a can of smashed assholes... Hate to say it, but the highway is for 4000lb vehicles moving at 90km/h+ controlled by distracted drivers with limited experience. I have been driving for 8 years, and I still fuck up on a daily bases. I think it is great that you have "stuck it to the man" Chris, but statutes and smooth talking aint gonna defy physics...
